Non-compliance penalties

According to the amended Biofuels Act (Consolidated Act No. 591 of April 7, 2021), in cases of non-compliance with the sustainability of biofuels, fixed financial penalty may be imposed and there may be criminal liability imposed on companies or legal persons.

The Executive Order (Consolidated Act No. 978 of July 1, 2025) on the reduction of greenhouse gases from the transport sector and sustainability refers to imposing fines on persons who provides false information, such as the origin of the feedstock used in biofuels production. The order reiterates the possibility of imposing criminal liability according to the rules of Chapter 5 of the Danish Criminal Code.
